Selling a property in Spain as a non-resident: what the official texts say
What the text on the non-resident income tax, its Reglamento, the Orden on Modelos 210 and 211 and the Agencia Tributaria say when a non-resident individual sells a property in Spain, with what we could not confirm.
This page covers individual non-residents with no permanent establishment who sell their own property in Spain. It does not cover companies, the foral territories, the specifics of Canarias, inheritance and gifts (see our guide to inheritance and wills in Spain), treaties and home-country tax, or reinvestment exemptions beyond the words of the rows quoted. Tax on a home in Spain that is not let is not covered yet.
It gives no calculation and no worked example, and says nothing of the amount of tax on any sale or whether any seller is a non-resident. For the tax on rent and on a home that is left empty, see our guide to non-resident rental property tax; for buying, our guide to buying property in Spain and our guide to the documents of a property purchase in Spain; for who is resident, our guide to Spanish tax residency; for the costs of a purchase, our property purchase costs calculator.
This guide reports what the BOE (the Official Journal, where the laws are published) and the Agencia Tributaria (AEAT, the Spanish tax agency) say about the tax on the sale of a property in Spain by an individual who is not resident: the buyer's withholding, the seller's own declaration and the form each uses. Quotes are in Spanish, the language of the source, with the article or page, a link, the date that source shows and the day we read it, 20 October 2026. The rows shared with our guide to buying property, our rental tax guide and our tax residency guide are shown unchanged, each with the date line stored there and the day that guide read it, 17, 18 or 20 October 2026. The English after a quote is our summary and says so; it is not a translation to rely on. This page is not advice.
If you read only one thing
- This page quotes the texts on a sale of property in Spain by a non-resident individual, and does not say the amount of tax on any sale or whether any seller is a non-resident: see what we could not confirm.
- The texts put two steps side by side: the buyer withholds and pays in a percentage of the agreed consideration on Modelo 211, and the non-resident seller declares the final tax on Modelo 210, offsetting what the buyer withheld; the quotes give the rate and the periods.
- Two AEAT sentences on a co-owned property are shown side by side and are not reconciled; the AEAT may change its pages.
Who is a non-resident taxpayer and what income is obtained in Spain
Art. 5 of the TRLIRNR (Real Decreto Legislativo 5/2004), as our guide to Spanish tax residency holds it, says, in its lead-in and letra a):
“Artículo 5. Contribuyentes. Son contribuyentes por este impuesto: a) Las personas físicas y entidades no residentes en territorio español conforme al artículo 6 que obtengan rentas en él, salvo que sean contribuyentes por el Impuesto sobre la Renta de las Personas Físicas.” (Real Decreto Legislativo 5/2004 (TRLIRNR), art. 5, lead-in and letra a))
Texto consolidado: «Última actualización, publicada el 25/05/2023»; read 20 October 2026

In short (our summary, not a translation): art. 5.a) names as taxpayers of the IRNR individuals and entities not resident in Spanish territory under art. 6 who obtain income there, unless they are taxpayers of the IRPF; art. 6 says residence is determined under an article of the earlier IRPF text and under an article of the earlier corporate tax text. Página actualizada: 26/septiembre/2024; read 20 October 2026
The AEAT's page on specific questions on the taxation of property lists, among the types of income from property of an individual non-resident taxpayer, this item:

Página actualizada: 26/septiembre/2024; read 20 October 2026
In short (our summary, not a translation): the texts say that gains on property situated in Spanish territory, or on rights relating to it, are income obtained in Spanish territory, and the AEAT lists a gain on a sale of the property among the types of income from property. Art. 25, apartado 1, letra f), item 3.º, as our rental tax guide holds it, says:

Página actualizada: 26/septiembre/2024; read 18 October 2026
In short (our summary, not a translation): the law and the AEAT's page each give the rate on gains from transfers of assets; the quotes give the rate. This page does not say whether the rate applies to any sale.

Texto consolidado: «Última actualización, publicada el 19/10/2019»; read 20 October 2026
Art. 4, apartado 4, of the Orden says:
“4. Cuando se haya practicado una retención o ingreso a cuenta sobre la renta del contribuyente superior a la cuota del Impuesto, se presentará autoliquidación para solicitar la devolución del exceso sobre la citada cuota, de acuerdo con lo establecido en el artículo 16 del Reglamento del Impuesto.” (Orden EHA/3316/2010 art. 4.4)
Texto consolidado: «Última actualización, publicada el 23/06/2026»; read 20 October 2026
In short (our summary, not a translation): both texts word that where a withholding or payment on account has been borne that is higher than the tax, a self-assessment is filed to request the return of the excess. This page does not say whether any excess arises on any sale or how long a return takes.
A co-owned property: two AEAT sentences, not reconciled
The AEAT's page on the filing of Modelo 210 (page dated 02/octubre/2026), as our rental tax guide holds it, says, for a sale:
“En el caso de transmisiones de bienes inmuebles, cuando el inmueble objeto de transmisión sea de titularidad compartida por un matrimonio en el que ambos cónyuges sean no residentes, se podrá realizar una única declaración.” (AEAT, Modelo y plazo de declaración, Agrupación de rentas, Caso particular)
Página actualizada: 02/octubre/2026; read 18 October 2026
The AEAT's page on specific questions on the taxation of property (page dated 26/septiembre/2024) says:
“Si un inmueble es propiedad de un matrimonio o de varias personas, cada una de ellas es un contribuyente independiente que deberá presentar declaraciones separadas.” (AEAT, «Cuestiones específicas sobre tributación de inmuebles», Tipos de rentas procedentes de inmuebles (page dated 26/septiembre/2024))
Página actualizada: 26/septiembre/2024; read 20 October 2026
This page does not reconcile the two sentences, and does not say which applies to any co-owned property.
A representative in Spain
Art. 10, apartado 1, first paragraph, of the TRLIRNR says:
(TRLIRNR (Real Decreto Legislativo 5/2004) art. 10.1, first paragraph)
Texto consolidado: «Última actualización, publicada el 25/05/2023»; art. 10: «Última actualización, publicada el 10/07/2021, en vigor a partir del 11/07/2021»; read 20 October 2026
The AEAT's page «Representación» says, with passages from two paragraphs and one list item quoted:
“Los contribuyentes residentes en otro Estado miembro de la Unión Europea (UE) … no tienen obligación de nombrar representante con residencia en España … Cuando, debido a la cuantía y características de la renta obtenida o a la posesión de un bien inmueble en territorio español, así lo requiera la Administración Tributaria.” (AEAT, «Representación», Obligación de nombramiento de representante (page dated 21/julio/2026; passages from two paragraphs and one list item))
Página actualizada: 21/julio/2026; read 20 October 2026
In short (our summary, not a translation): art. 10.1 words a duty, for taxpayers who are not resident in another Member State of the European Union, to appoint, before the end of the time allowed for filing the return on income obtained in Spain, a person or entity resident in Spain to represent them before the tax administration, when they operate through a permanent establishment, in the cases the article names, or when, because of the amount and characteristics of the income or the possession of immovable property in Spanish territory, the tax administration so requires; the AEAT's page words the same last case. This page does not say whether any seller is required to appoint a representative.
The municipal tax on the increase in urban land value
This page does not cover the municipal tax on the increase in urban land value (IIVTNU). Art. 104, apartado 1, of the texto refundido de la Ley reguladora de las Haciendas Locales (TRLRHL, Real Decreto Legislativo 2/2004) names it:
“Artículo 104. Naturaleza y hecho imponible. Supuestos de no sujeción. 1. El Impuesto sobre el Incremento de Valor de los Terrenos de Naturaleza Urbana es un tributo directo que grava el incremento de valor que experimenten dichos terrenos y se ponga de manifiesto a consecuencia de la transmisión de la propiedad de los terrenos por cualquier título o de la constitución o transmisión de cualquier derecho real de goce, limitativo del dominio, sobre los referidos terrenos.” (TRLRHL (Real Decreto Legislativo 2/2004) art. 104.1)
Texto consolidado: «Última actualización, publicada el 07/10/2026»; art. 104: «Última actualización, publicada el 22/03/2022, en vigor a partir del 23/03/2022»; read 20 October 2026
In short (our summary, not a translation): art. 104.1 names the tax as a direct tax on the increase in value of urban land shown on the transfer of the property of the land or on the constitution or transfer of a right over it. This page does not say whether or how the tax applies to any sale.
What we could not confirm
The list in the box at the end of this page, under “What we couldn't confirm officially”, holds what we could not confirm: how the two AEAT sentences on a co-owned property fit together; the articles of the TRLIRNR and the RIRNR that we did not quote; the AEAT procedure pages for Modelos 210 and 211; the municipal tax; how the gain is worked out; the filing date on the AEAT pages for buyers; and whether a later AEAT page or Orden changes the buyer's withholding.
