Foreign assets abroad: Modelo 720 and 721

What the BOE texts and the AEAT's own pages say about the Modelo 720 and the Modelo 721, the declarations of assets and virtual currencies held abroad: the legal texts, the three Modelo 720 categories, the limits, the filing window and what the AEAT FAQ says about some kinds of asset, with what we could not confirm.

This guide applies to people who are tax-resident in Spain, of any nationality, and it does not decide who must file.

See also our guide to the Spanish income tax return.

Spain asks residents to report some assets held abroad on two AEAT declarations, the Modelo 720 and the Modelo 721. This guide reports what the BOE texts and the AEAT's own pages say about them: what they are called, the legal texts they rest on, the three Modelo 720 categories, the Modelo 721, the limits, the filing window and what the AEAT FAQ says about some kinds of asset. It does not say whether anyone is obliged to file, what to declare or by when. Quotes are in Spanish, with the article or page, a link and the version or page date the source shows. The English after a quote is our translation or our summary, and says which; it is not a translation to rely on. Some quotes start or stop in the middle of a sentence, and the words around them are not shown. Numbers are written as the Spanish texts write them: 50.000 is fifty thousand.

If you read only one thing

  • The Modelo 720 has three categories of asset held abroad: accounts; securities, rights, insurance and income; and real estate. The AEAT says virtual currencies are not reported on it: virtual currencies held abroad are the subject of a separate declaration, the Modelo 721: see the three categories and the Modelo 721.
  • The limits are written in four articles of the Reglamento General (RGAT), not in the orders that approve the models: see where each number lives.
  • The rule on filing again in later years is shown only together with the cases the texts say apply in any event: see filing again.
  • The last filing window the AEAT pages quote has closed, and when we checked the AEAT had not published the next one: see the filing window.
  • The AEAT FAQ answers some questions about kinds of asset, but we found no official page that names the pension, retirement, savings or payment products readers ask about, so we classify none of them: see the list at the end.

What the AEAT calls them

On its filing-window page for the Modelo 720 (page updated 08/09/2026), the AEAT's heading is:

In English (our translation): declaration of information on assets and rights located abroad. On its procedure page for the Modelo 720 the AEAT carries this notice:

(AEAT Modelo 720 procedure page (GI34))
AEAT page; footer "Página actualizada: 13/octubre/2026"

In English (our translation): notice: virtual currencies are not reported on the Modelo 720. Orden HAP/72/2013 gives the model its full title:

(Orden HAP/72/2013, title)
consolidated: Última actualización publicada el 31/10/2023

In short (our summary, not a translation): the order approves the Modelo 720, the informative declaration on assets and rights located abroad that additional provision 18 of Ley 58/2003 refers to, and sets the place, form, time limit and procedure for filing it. The Modelo 721 has its own order:

(Orden HFP/886/2023, title)
BOE num. 180, 29/07/2023; in force 30/07/2023; no consolidated "Última actualización" line on the page; HAC/1504/2024 (BOE 31/12/2024) amends its annex

In short (our summary, not a translation): Orden HFP/886/2023 approves the Modelo 721, the informative declaration on virtual currencies located abroad, and sets the conditions and procedure for filing it. The AEAT's procedure pages list the two orders:

(BOE, 29-julio-2023)” (AEAT Modelo 721 procedure page (GI55))

The legal chain, with version dates

The texts we read have four layers: additional provision 18 of the General Tax Law (Ley 58/2003, General Tributaria, the LGT); the Reglamento General (RGAT, Real Decreto 1065/2007), whose articles 42 bis, 42 ter, 42 quater and 54 bis cover the four kinds of asset; the two orders that approve the models; and the AEAT's own pages. The first sentence of additional provision 18 says:

DA 18: last version published 10/03/2022, in force 11/03/2022 (Ley 5/2022 DF 4); earlier 10/07/2021 (Ley 11/2021); added 30/10/2012, in force 31/10/2012 (Ley 7/2012 art. 1.17); consolidated: Última actualización publicada el 21/12/2024

In English (our translation): taxpayers (obligados tributarios) are to supply the tax authority, as provided in arts. 29 and 93 of this law and in the terms set by regulation, the following information. Letters a) to d) follow:

(Ley 58/2003 (LGT), DA 18 a))

(Ley 58/2003 (LGT), DA 18 b))

DA 18: last version published 10/03/2022, in force 11/03/2022 (Ley 5/2022 DF 4); earlier 10/07/2021 (Ley 11/2021); added 30/10/2012, in force 31/10/2012 (Ley 7/2012 art.
(Ley 58/2003 (LGT), DA 18 d))

In short (our summary, not a translation): letter a) is about accounts abroad at entities engaged in banking or credit activity; b) about securities, rights, life or disability insurance and annuities contracted with entities established abroad; c) about real estate abroad; d) about virtual currencies abroad held in custody by persons who provide custody services. The provision goes on:

DA 18: last version published 10/03/2022, in force 11/03/2022 (Ley 5/2022 DF 4); earlier 10/07/2021 (Ley 11/2021); added 30/10/2012, in force 31/10/2012 (Ley 7/2012 art. 1.17); consolidated: Última actualización publicada el 21/12/2024

In short (our summary, not a translation): the obligations extend to those who count as beneficial owners (titulares reales) under art. 4.2 of Ley 10/2010. The BOE text of the provision carries two notes on where it comes from:

“Se añade por el art. 1.17 de la Ley 7/2012, de 29 de octubre. Ref. BOE-A-2012-13416” (Ley 58/2003 (LGT), DA 18, amendment note (Ley 7/2012))
DA 18: last version published 10/03/2022, in force 11/03/2022 (Ley 5/2022 DF 4); earlier 10/07/2021 (Ley 11/2021); added 30/10/2012, in force 31/10/2012 (Ley 7/2012 art. 1.17); consolidated: Última actualización publicada el 21/12/2024

and, on Ley 7/2012 itself:

“Diecisiete. 1.17)
BOE num. 261, 30/10/2012; in force 31/10/2012; consolidated: Última actualización publicada el 10/03/2022

In short (our summary, not a translation): art. 1.17 of Ley 7/2012 introduced the provision, and the wording in that law has since been replaced: the current wording comes from a later law, covered in the next section. The BOE pages show these version dates and consolidated-text dates:

Orden HFP/1180/2023 and Orden HAC/1504/2024 are named in those version lines; we read only their BOE pages' titles and dates, not their articles.

The annex of the Modelo 721 order has been replaced. The BOE page of Orden HFP/886/2023 carries this note, under "Referencias posteriores":

In English (our translation): the annex is replaced, by Orden HAC/1504/2024 of 26 December. We did not read the replacement.

The same order says, on when it first applies:

(Orden HFP/886/2023, DF 2)

In English (our translation): [the order] will apply for the first time to the Modelo 721, "Informative declaration on virtual currencies located abroad", for the year 2023, which will be filed between 1 January and 31 March 2024.

The 2022 change to the provision

The BOE text of additional provision 18 records its current wording as coming from a 2022 law:

Ref. BOE-A-2022-3712” (Ley 58/2003 (LGT), DA 18, amendment note (Ley 5/2022))
DA 18: last version published 10/03/2022, in force 11/03/2022 (Ley 5/2022 DF 4); earlier 10/07/2021 (Ley 11/2021); added 30/10/2012, in force 31/10/2012 (Ley 7/2012 art. 1.17); consolidated: Última actualización publicada el 21/12/2024

and the law itself says, in its fourth final provision:

59, 10/03/2022; in force 11/03/2022; page shows only "Texto inicial publicado el 10/03/2022"; not consolidated (initial text only)

In English (our translation): additional provision 18 of Ley 58/2003, the General Tax Law, is modified and is worded as follows. Its preamble says, on the reporting obligation:

(Ley 5/2022, preamble)
BOE num. 59, 10/03/2022; in force 11/03/2022; page shows only "Texto inicial publicado el 10/03/2022"; not consolidated (initial text only)

and goes on:

(Ley 5/2022, preamble)
BOE num. 59, 10/03/2022; in force 11/03/2022; page shows only "Texto inicial publicado el 10/03/2022"; not consolidated (initial text only)

In English (our translation): the judgment of the Court of Justice of the European Union (First Chamber) of 27 January 2022 in case C-788/19 determined that certain aspects of the legal regime associated with the obligation to declare assets and rights abroad (the Modelo 720) are in breach of European rules. Consequently, that legal regime needs to be modified to bring it into line with European law. This is what the preamble says. We did not read the judgment, and this page says nothing more about it or about what the regime was before.

Who the texts say is obliged

The four RGAT articles open with the same list of persons. For accounts, art. 42 bis.1 says:

In short (our summary, not a translation): each article names individuals and legal persons resident in Spanish territory, the permanent establishments in Spain of non-resident persons or entities, and the entities in art. 35.4 of Ley 58/2003. The first, third and fourth speak of an annual informative declaration; the second speaks of information supplied in an annual declaration. The Modelo 720 order says, in its art. 2:

In English (our translation): those obliged to file the Modelo 720, "Informative declaration on assets and rights located abroad", are the persons listed, when they are in any of the following cases. The list of cases is not quoted here. The Modelo 721 order says:

In English (our translation): those obliged to file the Modelo 721 are those delimited in paragraph 1 of art. 42 quater of the Reglamento General. The AEAT's Modelo 720 FAQ (updated to February 2025; page updated 08/09/2026) says:

(AEAT Modelo 720 FAQ: Contribuyentes obligados a declarar)
AEAT page; footer "Página actualizada: 08/septiembre/2026"

In English (our translation): it is understood that those obliged to file the Modelo 720 include, among others, individuals resident in Spanish territory, understood to include, for this purpose, all taxpayers who have to be taxed in the IRPF on the whole of their income. This page does not say whether you are in any of these groups.

Where each number lives

In the legal texts we read (the LGT, the RGAT and the two orders), the 50.000 limits are written only in four RGAT articles; the AEAT's FAQ pages also use the figure in their questions and worked examples, including the answer on a fiat-currency account quoted later. The orders approve the models and deal with filing: electronic filing and the window. Supplementary declarations are in Orden HAP/72/2013 only. The figure for filing again in later years is covered in its own section.

In English (our translation): accounts in financial entities located abroad (art. 42 bis); securities, rights, insurance and income deposited, managed or obtained abroad (art. 42 ter); real estate and rights over real estate located abroad (art. 54 bis). The FAQ adds:

(AEAT Modelo 720 FAQ index page)
AEAT page; footer "Página actualizada: 08/septiembre/2026"

In English (our translation): each of the three blocks of assets is a different reporting obligation, but the three obligations are carried through one and the same reporting model. The first three letters of additional provision 18, quoted above, are about accounts, securities and insurance, and real estate. The fourth letter, virtual currencies, is the one the AEAT's notice (quoted in the first section) says is not reported on the Modelo 720.

The 50.000 limits and the 31 December date

Each limit is stated as a joint one (the quotes use the word conjuntamente), and each quote goes on to say what applies if the limit is exceeded. For accounts, art.

(RGAT art. 42 bis.4.e))
art. 42 bis: text added 24/11/2012 (RD 1558/2012), in force 01/01/2013; no later version listed; consolidated: Última actualización publicada el 07/10/2026

In English (our translation): there is no obligation to report on any account when the balances at 31 December referred to in paragraph 2.d) do not exceed, jointly, 50.000 euros, and the same circumstance applies to the average balances referred to in the same paragraph. If either of those joint limits is exceeded, all the accounts are to be reported. Paragraph 2.d) is the reference date for accounts:

(RGAT art. 42 bis.2.d))
art. 42 bis: text added 24/11/2012 (RD 1558/2012), in force 01/01/2013; no later version listed; consolidated: Última actualización publicada el 07/10/2026

(RGAT art. 42 ter.4.c))
art. 42 ter: last version published 05/04/2023, in force 25/04/2023 (RD 249/2023 amended apdo 3 and 4.c); earlier 24/11/2012; consolidated: Última actualización publicada el 07/10/2026

In English (our translation): c) when the values referred to in each of paragraphs 1.b), 1.c) and 1.d), the liquidation value referred to in paragraph 2, the surrender value or mathematical provision referred to in paragraph 3.a) and the capitalisation value in paragraph 3.b) do not exceed, jointly, the amount of 50.000 euros. If that joint limit is exceeded, all the securities, assets, values, rights, insurance or income are to be reported. The lead-in to this letter is not in our quote. For real estate, art.

(RGAT art. 54 bis.6.d))
art. 54 bis: text added 24/11/2012 (RD 1558/2012), in force 01/01/2013; consolidated: Última actualización publicada el 07/10/2026

If that joint limit is exceeded, all the properties and rights over properties are to be reported. For the virtual-currency limit, see the Modelo 721. This page does not say whether a limit is reached in any case, and does not say how any asset is valued.

What the AEAT's Modelo 720 FAQ says about some kinds of asset

The answers below are the AEAT's words, given in full with the sentences that qualify them. They sit inside the limits above: this page does not say whether the limit is reached in any case, and it extends none of the answers to a named product. The AEAT's Modelo 720 FAQ (updated to February 2025; page updated 08/09/2026) says, on foreign pension plans:

In English (our translation): there is no obligation to report on pension plans (on contributions to them) as long as the event that leads to payment of the pension as temporary or lifetime income has not occurred. The same FAQ page also says:

In English (our translation): however, to the extent that the conditions of the foreign pension plan provide for the possibility of exercising the right of surrender in favour of the participant on the terms of a life insurance, it is to be reported under art. 42 ter.3.a). On exchange-traded funds, the same FAQ page says:

In English (our translation): ETFs are to be declared with the asset-type key I, shares and holdings in the share capital or equity of collective investment institutions located abroad. The FAQ asks:

In English (our translation): is there an obligation to report on assets such as works of art, boats, (physical) gold bars, jewellery, cash not deposited in accounts? The answer on that page is:

In English (our translation): there is no obligation to report on these assets understood as such. The same page adds this qualifier:

In English (our translation): the matter is different if these assets are the underlying of assets and rights that are the object of the informative declaration. On unit-linked life insurance (the question is not part of our quote), the same FAQ page answers:

In English (our translation): yes, the fact that the policyholder bears the investment risks in which the provisions are invested does not alter the obligation to declare.

Filing again in later years

The texts also contain a rule on filing again. It is written in the same four RGAT articles as the limits, repeated in the AEAT's FAQs and repeated in the field instructions of the annex of the Modelo 720 order. Each quote below is followed by the cases that the RGAT or the AEAT puts next to it, and the two go together: the rule for later years is not the whole of the texts on filing again. For accounts, art.

(RGAT art. 42 bis.5)
art. 42 bis: text added 24/11/2012 (RD 1558/2012), in force 01/01/2013; no later version listed; consolidated: Última actualización publicada el 07/10/2026

In English (our translation): filing the declaration in later years will be mandatory only when any of the joint balances referred to in paragraph 4.e) has increased by more than 20.000 euros compared with those that determined the filing of the last declaration. The same article also says:

art. 42 bis: text added 24/11/2012 (RD 1558/2012), in force 01/01/2013; no later version listed; consolidated: Última actualización publicada el 07/10/2026

In English (our translation): in any event, filing the declaration will be mandatory in the cases provided for in the last paragraph of paragraph 3, for the accounts to which it refers. Art. 42 bis.3 says, on other holders:

(RGAT art. 42 bis.3)
art. 42 bis: text added 24/11/2012 (RD 1558/2012), in force 01/01/2013; no later version listed; consolidated: Última actualización publicada el 07/10/2026

In English (our translation): the other holders, representatives, authorised persons, beneficiaries, persons with powers of disposal or beneficial owners are to state the account balance at the date on which they ceased to have that status. art. 42 ter: last version published 05/04/2023, in force 25/04/2023 (RD 249/2023 amended apdo 3 and 4.c); earlier 24/11/2012; consolidated: Última actualización publicada el 07/10/2026

In English (our translation): filing the declaration in later years will be mandatory only when the joint value of all the securities provided for in paragraph 4.c) has increased by more than 20.000 euros compared with the one that determined the filing of the last declaration. The same article also says:

(RGAT art. 42 ter.5)
art. 42 ter: last version published 05/04/2023, in force 25/04/2023 (RD 249/2023 amended apdo 3 and 4.c); earlier 24/11/2012; consolidated: Última actualización publicada el 07/10/2026

art. 54 bis: text added 24/11/2012 (RD 1558/2012), in force 01/01/2013; consolidated: Última actualización publicada el 07/10/2026

In English (our translation): in any event, filing the declaration will be mandatory in the cases provided for in paragraph 5, for the properties or rights whose ownership ended at 31 December. For virtual currencies, art. 42 quater.6 says:

In English (our translation): the other holders, beneficiaries, authorised persons, persons with powers of disposal or beneficial owners are to state the balances of the virtual currencies at the date on which they ceased to have that status. The AEAT's Modelo 720 FAQ (updated to February 2025; page updated 08/09/2026) says:

In English (our translation): this Model is to be filed again only when, in relation to one or several of these obligations, there is an increase in the joint limit established for each block of information of more than 20.000 euros compared with the one that determined the filing of the last declaration. The same FAQ page contains this parenthesis:

In English (our translation): (and no other cause for its declaration applies either, such as, for example, its transfer). The AEAT's Modelo 721 FAQ (page updated 08/09/2026) says:

In English (our translation): filing the declaration in later years will be mandatory only when the joint balance at 31 December of the virtual currencies abroad, valued in euros, has increased by more than 20.000 euros compared with the one that determined the filing of the last declaration. The field instructions of the annex of Orden HAP/72/2013 repeat the rule:

annex: last version published 31/10/2023, in force 01/11/2023 (Orden HFP/1180/2023 art. 2.2, BOE-A-2023-22221; applies first to ejercicio 2023 returns filed from 1 January 2024); original text 31/01/2013, in force 01/02/2013; consolidated: Última actualización publicada el 31/10/2023; ejercicio: wording applies from ejercicio 2023

In English (our translation): had experienced an increase of more than 20.000 € compared with the one that determined the filing. The BOE prints "determino" without the accent. These quotes, with the cases beside them, are all this page says on filing again; it does not say whether a sale, a closure or a change in value means a new declaration for any reader.

The filing window

The RGAT says the same thing in three places. Art. 42 bis.5, for accounts, says:

(RGAT art. 42 bis.5)
art. 42 bis: text added 24/11/2012 (RD 1558/2012), in force 01/01/2013; no later version listed; consolidated: Última actualización publicada el 07/10/2026

In English (our translation): this obligation is to be met between 1 January and 31 March of the year after the one to which the information to be supplied refers. Art. 54 bis.7 and art. 42 quater.6 use the same words:

(RGAT art. 54 bis.7)
art. 54 bis: text added 24/11/2012 (RD 1558/2012), in force 01/01/2013; consolidated: Última actualización publicada el 07/10/2026

The orders repeat the window. Orden HAP/72/2013, art. 7, says:

(Orden HAP/72/2013, art. 7)
art. text unchanged since original: published 31/01/2013 (BOE num. 27), in force 01/02/2013; consolidated: Última actualización publicada el 31/10/2023

In English (our translation): [the filing] will be done between 1 January and 31 March of the year after the one to which the information to be supplied refers. The Modelo 721 FAQ says it too:

AEAT page; footer "Página actualizada: 08/septiembre/2026"

The AEAT's Modelo 720 filing-window page (page updated 08/09/2026) says:

It closed on 31 March 2026. As of 18 October 2026 the AEAT had not published the next window. The AEAT's page and the Orden give different numbers of days for a technical failure of the electronic service, so we give no number.

How the declaration is filed

Orden HAP/72/2013, art. 4, says:

art. text unchanged since original: published 31/01/2013 (BOE num. 27), in force 01/02/2013; consolidated: Última actualización publicada el 31/10/2023

In English (our translation): the declaration can be filed using the web form available on the AEAT's Electronic Office. This page does not say how to sign in.

The Modelo 721: virtual currencies held abroad

Letter d) of additional provision 18, quoted above, is about virtual currencies held abroad; the Modelo 721 order refers to art. 42 quater of the RGAT for who files. The RGAT defines the concept by reference. Art. 42 quater.2 says:

42 quater.2)

In English (our translation): the concept of virtual currency is understood as provided in art. 1.5 of Ley 10/2010. The AEAT's Modelo 721 FAQ (page updated 08/09/2026) says:

art. 42 quater: text added 05/04/2023 (RD 249/2023), in force 25/04/2023; consolidated: Última actualización publicada el 07/10/2026

The quote stops there. The Modelo 721 FAQ says, on who files:

(RGAT art. 42 quater.3.c))
art. 42 quater: text added 05/04/2023 (RD 249/2023), in force 25/04/2023; consolidated: Última actualización publicada el 07/10/2026

In English (our translation): c) the balances of each type of virtual currency at 31 December, expressed in units of virtual currency and their valuation in euros. The FAQ page also contains these words:

“a 31 de diciembre de cada año.” (AEAT Modelo 721 FAQ: Quienes estan obligados)
AEAT page; footer "Página actualizada: 08/septiembre/2026"

In English (our translation): at 31 December of each year. The limit, in art. 42 quater.5.d), says:

(RGAT art. 42 quater.5.d))
art. 42 quater: text added 05/04/2023 (RD 249/2023), in force 25/04/2023; consolidated: Última actualización publicada el 07/10/2026

In English (our translation): there is no obligation to report on any virtual currency when the balances at 31 December referred to in paragraph 3.c), valued in euros, do not exceed, jointly, 50.000 euros. If that joint limit is exceeded, all the virtual currencies are to be reported. The rule for filing again is in its own section, with the cases beside it.

What the AEAT's Modelo 721 FAQ says about some situations

Like the Modelo 720 answers above, these sit inside the limit just quoted, are given in full with their qualifiers, and are not extended to any named product or service. The AEAT's Modelo 721 FAQ (page updated 08/09/2026) says, in one sentence, with words between the two parts that we do not show:

(AEAT Modelo 721 FAQ: Quienes estan obligados)
AEAT page; footer "Página actualizada: 08/septiembre/2026"

In English (our translation): "… the virtual currencies kept in wallets for which the person asking (el consultante) keeps control of the private cryptographic keys … would not be reported within the framework of the obligation to report on virtual currencies located abroad." The English keeps the AEAT's conditional. Still in the Modelo 721 FAQ (page updated 08/09/2026), on a fiat-currency account at a foreign exchange:

In English (our translation): indeed, as long as none of the cases provided for in art. 42 bis.4 of the RGAT applies, the account in euros or another fiat currency of legal tender kept with the foreign "exchange" it operates with is to be reported when the joint computation of any of the balances referred to in paragraph 2.d) of art. 42 bis of the RGAT exceeds 50.000 euros for all the accounts located abroad taken together. The same FAQ page says, on the Modelo 721:

and goes on:

In English (our translation): in the Modelo 721, "Informative declaration on virtual currencies located abroad", information is to be provided only on the virtual currencies located abroad. All of this is without prejudice to the obligation that may exist under art. 42 bis of the RGAT to report in the Modelo 720 on the instrumental account located abroad into which those funds in fiat currency are paid. On the custodians that count, the Modelo 721 FAQ says:

In English (our translation): in the following interactive query of the Banco de España, the location of the providers of virtual-currency exchange services for fiduciary currency and/or custody of electronic wallets registered with the Banco de España can be consulted. We do not link that tool and have not used it; the AEAT page that mentions it is linked here. This page names no exchange or custodian.

The special regime for workers moving to Spain (art. 93 of the IRPF law)

This section quotes one AEAT FAQ page; see the note after the quotes on how old its wording may be. The AEAT's Modelo 720 FAQ page "Contribuyentes obligados a declarar" (page updated 08/09/2026) shows two questions, one after the other. The first is:

(AEAT Modelo 720 FAQ: Contribuyentes obligados a declarar)
AEAT page; footer "Página actualizada: 08/septiembre/2026"

In English (our translation): is an individual resident in Spain who benefits from the special tax regime for workers posted to Spanish territory provided for in art. 93 of Ley 35/2006, the personal income tax law, obliged to file this informative declaration on assets and rights located abroad? The second is:

(AEAT Modelo 720 FAQ: Contribuyentes obligados a declarar)
AEAT page; footer "Página actualizada: 08/septiembre/2026"

In English (our translation): are the spouse and children of the individual resident in Spain who benefits from this tax regime obliged to report? On the AEAT page, the two questions are followed by a single answer, "No.", and then by a note headed Normativa. This page does not say how that single "No." applies to each question, and does not reconcile it with the note, which we quote separately. The note begins:

(AEAT Modelo 720 FAQ: Contribuyentes obligados a declarar)
AEAT page; footer "Página actualizada: 08/septiembre/2026"

In English (our translation): the obligation to report on assets and rights located abroad, although it is not tied to any specific tax, has the possible consequences in case of non-compliance regulated for some taxes. The note continues:

(AEAT Modelo 720 FAQ: Contribuyentes obligados a declarar)
AEAT page; footer "Página actualizada: 08/septiembre/2026"

In English (our translation): specifically for personal income tax, these consequences are limited to taxpayers obliged to be taxed in the tax on the whole of their income, a circumstance that does not apply to the individuals under the aforementioned tax regime provided for in art. 93 of the IRPF law, so they are not obliged to fill in the new informative declaration. Further down the same page, on the family members:

(AEAT Modelo 720 FAQ: Contribuyentes obligados a declarar)
AEAT page; footer "Página actualizada: 08/septiembre/2026"

In English (our translation, the quote starts in the middle of a sentence): "… is not extensible to the rest of the members of the family unit, who may be subject to the obligation to report on assets and rights located abroad to the extent that they are tax residents in Spain." We quote the three passages as the AEAT words them and give no view on how they fit together.

How old this is

  • The AEAT's FAQ index labels the series "(Actualizadas a febrero de 2025)", and the note speaks of "la nueva declaración informativa", wording that reads like text written when the declaration was new (our reading).
  • Additional provision 18 of the LGT was rewritten in 2022 (see the 2022 change), and we found no newer official statement on this point.
  • For the Modelo 721 this is not confirmed: we found no official statement.

Which administration receives the filing

The same AEAT FAQ page says, on where the declaration is filed:

(AEAT Modelo 720 FAQ: Contribuyentes obligados a declarar)
AEAT page; footer "Página actualizada: 08/septiembre/2026"

In English (our translation): the informative declaration on assets and rights located abroad is filed either with the State Administration in the form, place and time limits approved by Orden HAP/ 72/2013 of 30 January, or with the competent Foral Community or Foral Diputación in the form, place and time limits those bodies approve, depending on whether the taxpayers are subject to the state or the foral rules. This page covers the state filing only and states nothing else about País Vasco or Navarra.

Questions to take to the AEAT or a tax adviser

  • Ask whether a foreign pension, ISA or retirement account counts as an account, a security or insurance for the Modelo 720.
  • Ask whether an e-money or payment account (such as Wise or Revolut) is an account at an «entidad que se dedique al tráfico bancario o crediticio».
  • Ask whether the AEAT FAQ on art. 93 still applies to you and what applies to your spouse and children.
  • Ask whether your crypto custodian is «situado en el extranjero».
  • Ask whether a sale or closure this year means you must file again.

Where to go next

  1. Read the AEAT pages linked above for the declaration that applies to you: they are where the windows and forms are published. This page classifies no pension, retirement, savings or payment product.
  2. The opposite case, a non-resident who owns property in Spain, is in our guide to tax on a Spanish rental property for a non-resident owner.
  3. Tax residency for an employee working remotely is in our guide to working remotely for a UK employer; this page does not say how it relates to these declarations.
  4. The Beckham law calculator, the UK pensions calculator, the guide for US citizens on visa paperwork and the bank account guide each cover their own topics, and this page does not say whether they matter for these declarations.
  5. Registering in Spain is covered in our padrón guide and the NIE guide; this page does not say whether registration matters for these declarations.
