TIE renewal and long-term residence in Spain: what RD 1155/2024 and the ministry say
What Real Decreto 1155/2024 (the BOE text) and the pages of the Spanish Ministry of Inclusion say about the foreigner identity card (TIE), the renewal windows as they are worded for two kinds of authorisation, and long-term residence, with what we could not confirm.
This page reports what the regulation and the ministry's pages say; it is not advice.
The rules on foreigners in Spain sit in a regulation published in the BOE, the official gazette: Real Decreto 1155/2024, which approves the Reglamento of the Ley Orgánica 4/2000. The Spanish Ministry of Inclusion, Social Security and Migration (Ministerio de Inclusión, Seguridad Social y Migraciones) publishes information sheets and pages on the same subject. This page reports what those texts say about the foreigner identity card (tarjeta de identidad de extranjero, TIE), about the windows for renewing two kinds of authorisation, and about long-term residence. It does not decide anyone's situation and it computes no date. Quotes are in Spanish (GOV.UK in English), with the article or page, a link, the date that source shows and the day we read it, 18 October 2026. The English after a quote is our translation or our summary, and says which; it is not a translation to rely on. The page gives no fee, processing time or appointment step.
If you read only one thing
- The regulation is quoted from the BOE's consolidated text, which the BOE says has no legal value: see the regulation and its change history.
- The texts we read do not say which Reglamento governs a renewal, filed after 20/05/2025, of an authorisation granted under RD 557/2011: see the transitional provisions.
- Renewal windows are quoted for two kinds of authorisation only. The regulation words an extension of validity («se prorrogará») and a ministry sheet words something that «se puede solicitar»; the two are kept apart: see the renewal windows.
- Long-term residence is quoted as the regulation and the ministry words it, with the schedule and windows for renewing the card: see long-term residence.
- The section on the Withdrawal Agreement covers UK citizens, and their family members, covered by that Agreement only: see the Withdrawal Agreement card.
What we could not confirm
- The texts we read do not say which Reglamento governs a renewal, filed after 20/05/2025, of an authorisation granted under RD 557/2011. unverified
- The police side of the TIE: we did not retrieve the pages of the police or of the Ministry of the Interior, so this page gives no police procedure and no list of documents. unverified
- How long a TIE is valid for each type of authorisation: the regulation's article on the card says only that it has the same period of validity as the authorisation, and no length is given here. unverified
- The renewal windows and conditions for the other kinds of authorisation, among them the teleworker (digital nomad) authorisation, family reunification, self-employed work and studies: each has its own articles, which are not quoted here. unverified
- Whether the two-month window quoted for the non-lucrative and employed authorisations applies in the same words to any other authorisation: each article states its own window, and only two are quoted. unverified
- Whether the ministry sheets and the ministry Brexit pages are up to date: the sheets show a month and year, the Brexit web pages show no date, and the Brexit guide is dated on its cover. unverified
- Whether the BOE consolidated text has been amended since the day we read it; the BOE also says the consolidated text has no legal value. unverified
- Renewal of the Withdrawal Agreement document and permanent residence under the Agreement: not covered, and not confirmed from the pages we read. unverified

None of the articles quoted here carries a modification or annulment note in that text.
The 2011 regulation, and the transitional provisions
The single repealing provision of Real Decreto 1155/2024 says:

The BOE page of the 2011 Real Decreto carries this note:
Ref. BOE-A-2024-24099” (RD 557/2011, BOE page note)

In English (our translation): rule repealed, with effect from 20 May 2025, by the single repealing provision of Royal Decree 1155/2024, of 19 November. Ref. BOE-A-2024-24099. The first two transitional provisions say:

In English (our translation): the various authorisations or cards that enable a person to enter, reside and work in Spain, granted to the persons within the scope of the regulation approved by this royal decree and valid on the date of its entry into force, will keep that validity for the time for which they were issued. Applications filed before the entry into force of this royal decree will be processed and resolved under the rules in force on the date they were filed, unless the interested party requests the application of what the Regulation of Organic Law 4/2000, of 11 January, on the rights and freedoms of foreigners in Spain and their social integration provides, and provided that compliance with the requirements for each type of application is shown.
The texts we read do not say which Reglamento governs a renewal, filed after 20/05/2025, of an authorisation granted under RD 557/2011. This page does not say.
The TIE card in the regulation
Article 206 of the regulation lists the documents that may show a foreigner's situation:
(RD 1155/2024, art. 206)
BOE consolidated text, Última actualización publicada el 22/09/2026; read 18 October 2026
In English (our translation): the various situations of foreigners in Spain may be shown, as applicable, by the passport or travel document that proves their identity, the visa, the administrative decision that authorises their stay in Spain, the foreigner identity card, or the certificate of resident and non-resident. The BOE text has no comma after «España»; we have not added one. Article 209 is headed «La tarjeta de identidad de extranjero» (the consolidated text prints that heading; it is not stored as a row). Its first paragraph says:
(RD 1155/2024, art. 209.1)
BOE consolidated text, Última actualización publicada el 22/09/2026; read 18 October 2026
In English (our translation): 1. All foreigners who have been issued a visa or an authorisation to remain in Spain for a period of more than six months have the right and the duty to obtain the foreigner identity card, which they must apply for in person within one month from their entry into Spain or from the authorisation being granted or taking effect, depending, where applicable, on their registration in the relevant Social Security regime, respectively. Paragraphs 2 and 3 say:
(RD 1155/2024, art. 209.3)
BOE consolidated text, Última actualización publicada el 22/09/2026; read 18 October 2026
In English (our translation): 2. The foreigner identity card is the document intended to identify the foreigner for the purpose of proving their legal situation in Spain. 3. The foreigner identity card is personal and non-transferable, and it falls to its holder to carry out the steps established for obtaining and collecting it, and to keep and preserve the document. Paragraph 7 ties the card to the authorisation:
(RD 1155/2024, art. 209.7)
BOE consolidated text, Última actualización publicada el 22/09/2026; read 18 October 2026
In English (our translation): 7. The foreigner identity card will have the same period of validity as the authorisation or recognition of the right that justifies its issue, and will lose its validity when that of the said authorisation is lost, for any of the causes established in the regulations for that purpose or, where applicable, through the loss of the right to remain in Spanish territory. This page gives no length of validity for any type of authorisation. Paragraph 8 says, in its first paragraph:
(RD 1155/2024, art. 209.8)
BOE consolidated text, Última actualización publicada el 22/09/2026; read 18 October 2026
In English (our translation): 8. When the period of validity of the card has ended, the renewal of the authorisation or, where applicable, of the recognition to remain in Spanish territory has been agreed, or the right that justified its issue has been lost, the foreigners holding it are obliged to hand the document in at the police stations corresponding to the place where they live. Paragraphs 9 and 10 distinguish a replacement from a renewal:
(RD 1155/2024, art. 209.10)
BOE consolidated text, Última actualización publicada el 22/09/2026; read 18 October 2026
In English (our translation): 9. The loss, destruction or rendering unusable of the foreigner identity card, whether personal, employment or family, will lead to the issue of a new card, at the request of the interested party, which will not be considered a renewal and will be valid for the time remaining until the expiry of the one it replaces. If the application for a new card is made within the renewal period of the authorisation, the procedures will be processed jointly and consistently. 10. Modifications that involve an alteration of the legal situation in Spain of the holder of the card, as well as of their employment situation, including renewals, will lead to the issue of a new card adapted to the change or alteration, with the validity determined by the decision granting those modifications. Paragraph 4 refers to a sanctions regime:
(RD 1155/2024, art. 209.4)
BOE consolidated text, Última actualización publicada el 22/09/2026; read 18 October 2026
In English (our translation): 4. Failure to comply with the obligations relating to the foreigner identity card will lead to application of the sanctions regime provided for in Organic Law 4/2000, of 11 January. This page names the regime and gives no content of it.
Renewing a temporary residence authorisation: the windows as worded
This section quotes the renewal windows for two kinds of authorisation only: the non-lucrative residence authorisation (article 64) and the residence and employment authorisation for work as an employee (article 80). The other authorisations have their own articles, which are not quoted here: among them the teleworker (digital nomad) authorisation under Ley 14/2013, family reunification, self-employed work and studies. This page does not say whether the window quoted for one authorisation applies to another. Our visa comparison covers the renewal of the teleworker authorisation.
Article 60.1 defines temporary residence:
(RD 1155/2024, art. 60.1)
BOE consolidated text, Última actualización publicada el 22/09/2026; read 18 October 2026
In English (our translation): 1. A foreigner is in the situation of temporary residence when authorised to remain in Spain for a period of more than ninety calendar days and less than five years, without prejudice to what is established on stays for studies, student mobility, voluntary service or training activities.
Non-lucrative authorisation: article 64
Article 64 is headed «Renovación de la autorización de residencia temporal no lucrativa» (the consolidated text prints that heading; it is not stored as a row). Its first paragraph, whole, says:
(RD 1155/2024, art. 64.1)
BOE consolidated text, Última actualización publicada el 22/09/2026; read 18 October 2026
In English (our translation): 1. A foreigner who wishes to renew their temporary residence authorisation must apply to the foreigners' office competent to process it during the two months before the date on which the validity of their authorisation expires. Filing the application within this period extends the validity of the previous authorisation until the procedure is resolved. It will also be extended until the procedure is resolved where the application is filed within the three months after the date on which the validity of the previous authorisation ended, without prejudice to the opening of the corresponding sanctioning procedure for the infringement provided for in article 52.b) of Organic Law 4/2000, of 11 January. This page names that sanctioning procedure and gives no content of it. Paragraph 2.a) of the same article says:
(RD 1155/2024, art. 64.2.a))
BOE consolidated text, Última actualización publicada el 22/09/2026; read 18 October 2026
In English (our translation): a) Holding a non-lucrative temporary residence authorisation in force or being within the three months after its expiry. Paragraph 7 says:
(RD 1155/2024, art. 64.7)
BOE consolidated text, Última actualización publicada el 22/09/2026; read 18 October 2026
In English (our translation): 7. The renewed temporary residence authorisation will be valid for two years, unless a long-term residence authorisation or a long-term-EU residence authorisation is due. Paragraph 9 says:
(RD 1155/2024, art. 64.9)
BOE consolidated text, Última actualización publicada el 22/09/2026; read 18 October 2026
In English (our translation): 9. Within one month from the notification of the decision renewing the authorisation, its holder must personally apply, at the competent Police Station, for the corresponding foreigner identity card.
Residence and employment as an employee: article 80
Article 80 is headed «Renovación de las autorizaciones de residencia temporal y trabajo por cuenta ajena» (the consolidated text prints that heading; it is not stored as a row). Its first paragraph, whole, says:
(RD 1155/2024, art. 80.1)
BOE consolidated text, Última actualización publicada el 22/09/2026; read 18 October 2026
In English (our translation): 1. The renewal of the temporary residence and employment (as an employee) authorisations must be applied for, on the official form, during the two months before the date on which the validity of their authorisation expires. Filing the application within this period will extend the validity of the previous authorisation until the procedure is resolved. It will also be extended until the procedure is resolved where the application is filed within the three months after the date on which the validity of the previous authorisation ended, without prejudice to the opening of the corresponding sanctioning procedure for the infringement provided for in article 52.b) of Organic Law 4/2000.
The ministry's sheet 7
The Ministry of Inclusion's sheet 7, «Renovación de la autorización de residencia temporal no lucrativa» (the page shows «Última actualización: mayo de 2025»), words the window in its own sentences, which are not the regulation's:
(Ministry of Inclusion, sheet 7, application period)
Ministry page, Última actualización: mayo de 2025; read 18 October 2026
In English (our translation): application period: during the two months before the date on which the validity of their authorisation expires. It may also be applied for within the three months after the date on which the validity of the authorisation ended, without prejudice to the possibility that the corresponding sanctioning procedure be opened. Filing the application within the period extends the validity of the previous authorisation until the procedure is resolved. The regulation (article 64.1, above) words the three-month part as an extension of validity («se prorrogará»); the sheet words it as something that may be applied for («se puede solicitar»). This page keeps the two wordings apart and does not reconcile them. The sheet then says:
(Ministry of Inclusion, sheet 7, procedure)
Ministry page, Última actualización: mayo de 2025; read 18 October 2026
In English (our translation): within one month from the notification of the renewal of the temporary residence authorisation, the foreigner must apply for the renewal of the foreigner identity card at the Police Station or competent police services of their place of residence. Article 64.9 (above) speaks of applying for «la correspondiente tarjeta de identidad de extranjero»; the sheet speaks of the «renovación de la tarjeta». The two wordings are kept apart. The sheet carries this caveat, which sheets 49 and 50 below also print:
(Ministry of Inclusion, sheet 7, caveat)
Ministry page, Última actualización: mayo de 2025; read 18 October 2026
In English (our translation): the content of this page is merely indicative. Only what is established in the regulations in force at the time the application is filed applies.
The ministry's page «Sí tiene autorización para residir en España» (the page shows no date) describes «Renovación o prórroga» in one line:
(Ministry of Inclusion, Sí tiene autorización)
Ministry page; the page shows no date; read 18 October 2026
In English (our translation): continuity of the situation in which the foreigner finds themselves, provided the same requirements that were demanded for its granting are maintained.
Long-term residence, as worded
The regulation defines national long-term residence (article 182) and long-term-EU residence (article 175). This page quotes articles 182 to 185 and 175 to 178, and not the regulation's other articles on long-term residence. It quotes what each article and each ministry sheet says, and does not say whether any person meets the wording.
National long-term residence
Article 182 defines it:
(RD 1155/2024, art. 182)
BOE consolidated text, Última actualización publicada el 22/09/2026; read 18 October 2026
In English (our translation): a foreigner is in the national long-term residence situation when authorised to reside and work in Spain indefinitely on the same terms as Spaniards. Article 183.1 and 183.2 say:
(RD 1155/2024, art. 183.2)

What is provided in the previous paragraph will not apply to foreigners who hold a residence authorisation in force and already comply with what is established in article 183. This page does not interpret the last sentence. Article 184.7 says:

Article 175 defines it:
(RD 1155/2024, art. 175)

However, failure to comply with the obligations relating to the foreigner identity card will lead to application of the sanctions regime provided for in Organic Law 4/2000, of 11 January. This page names the regime and gives no content of it. A textual note: article 185.2 above ends with a clause beginning «sin perjuicio de la incoación del correspondiente procedimiento sancionador», and article 178.2, as quoted here, has no such clause. This page draws no conclusion from the difference.
The ministry's sheets 49 and 50 and its page on authorisations
Sheets 49 and 50 print the same caveat as sheet 7 (quoted above): «El contenido de esta página es meramente orientativo.
The ministry's sheet 49, «Autorización de residencia de larga duración nacional» (the page shows «Última actualización: mayo de 2025»), says:

The Withdrawal Agreement card
This section covers UK citizens (and their family members) covered by the Withdrawal Agreement only.
The Ministry of Inclusion's Brexit page for people resident in Spain on 31 December 2020 (the page shows no date) states its audience:
“Información dirigida a los nacionales del Reino Unido residentes en España antes del 31 de diciembre de 2020 y a sus familiares” (Ministry of Inclusion, Brexit: residents on 31 December 2020)
Ministry page; the page shows no date; read 18 October 2026

A ministry guide of September 2024, a PDF of questions and answers for UK nationals (the cover shows «Septiembre de 2024»), says:
50 TUE).” (Ministry of Inclusion, Brexit guide (ministry guide, September 2024))
Ministry guide (PDF); the cover shows «Septiembre de 2024»; read 18 October 2026
In English (our translation): once their status as a beneficiary of the Withdrawal Agreement has been shown, the person may apply for the issue of a foreigner identity card (TIE) that shows them as a beneficiary of the Withdrawal Agreement (TIE art. 50 TUE). The ministry prints the label as «TIE art. 50 TUE». The guide is dated September 2024 and the ministry's web pages are undated; this page does not say whether the guide is still current.
GOV.UK, the UK government's site, is not a Spanish source. Its page «Spain: registering as a resident and getting a TIE» (published 22 December 2025) says:
“How to register as a resident in Spain if you are a British citizen and how to get or renew a foreigner’s identity card (‘TIE’).” (GOV.UK, Spain: registering as a resident and getting a TIE)
GOV.UK, published 22 December 2025; read 18 October 2026
“You’ll get a TIE with the words ‘Articulo 50 TUE’ printed on it. This shows that you have rights under the Withdrawal Agreement.” (GOV.UK, Spain: registering as a resident and getting a TIE)

“We provide this information as a guide only. For definitive information, contact the Spanish authorities.” (GOV.UK, Spain: registering as a resident and getting a TIE)
GOV.UK, published 22 December 2025; read 18 October 2026
GOV.UK prints the label as «Articulo 50 TUE», without the accent, and says of its own page that it is a guide only.
Renewal of the Withdrawal Agreement document and permanent residence under the Agreement are not covered here. The sources are GOV.UK's page, Spain: registering as a resident and getting a TIE, and the ministry's Brexit page.
How current each source is
Questions to take to the foreigners' office or a gestor
- Ask whether the 2011 regulation or the 2024 regulation governs a renewal of an authorisation granted before 20 May 2025.
- Ask whether the two-month window applies to the type of authorisation held.
- Ask what documents the police require for the card.
- Ask how long the card is valid for the authorisation held.
- Ask whether the other routes listed in article 183.3 apply to the situation.
Where to go next
- Read the BOE page and the ministry pages linked above: they are where the current wording is published.
- Our NIE guide covers the NIE and describes the card in outline.
