Creators and influencers: what the official texts say about autónomo rules

What the official texts say about the self-employed definitions, the monthly cuota, IVA and the returns, and where they stop.

This guide reports what the official texts say on points that matter to someone who creates content and works for themselves in Spain. This page doesn't decide whether you must register. It shows the official wording and questions to take to a gestor. It does not tell you which forms apply to you or what you owe, and it names no platform. Quotes are in Spanish, the language of the source, with the article or page and a link. The sentences that follow a quote are our own summary of it, not a translation to rely on. It does not cover Verifactu, nor the further rules named in the list of what we could not confirm.

Words used on this page

  • Regularisation (regularización): the later check by the Seguridad Social described in the quotes below.
  • Definitive base (base de cotización definitiva): the base that the quotes below say is worked out in that later check.
  • Sujeto pasivo: the word the IVA quotes use for the taxpayer, which the headings above the quotes translate as taxpayer; each quote says who is meant.
  • ROI (Registro de Operadores Intracomunitarios): the register named in the AEAT quote on identification for operations with other EU businesses, below.
  • NIF-IVA: the number that the same AEAT quote says a business is obliged to obtain by registering in the ROI, in the cases it lists.
  • Ingreso a cuenta: the payment on account that the quotes on actividades profesionales name beside retención (withholding); we did not research what each covers.

What the definitions say

Two official texts define the people the rules on the self-employed apply to. The first is the Estatuto del Trabajo Autónomo (Ley 20/2007):

The second is the Ley General de la Seguridad Social (LGSS), on who is obligatorily included in the self-employed scheme (RETA):

(Real Decreto Legislativo 8/2015 (LGSS), art. 305.1)

In English: both texts describe a natural person who carries out an economic or professional activity for profit, habitually, personally, directly, on their own account and outside the sphere of direction and organisation of another person; the LGSS adds that the person is over eighteen (mayores de dieciocho años). We do not say whether the activity of any creator meets these definitions, or whether it is professional or business activity for tax purposes: we did not find an official text that answers either question.

How the monthly cuota works

The cuota is the monthly contribution to the Seguridad Social. Our autónomo social security calculator holds the 2026 bands and rates and works out a cuota from them, so this guide repeats none of those figures. What follows is how the law describes choosing the base and checking it afterwards. This is our own summary of art. 308 of the LGSS, not a quote:

  1. You choose a monthly base from your forecast of the monthly average of your annual net earnings (art. 308.1.a) regla 1.ª). The law provides for the base to be changed on terms set by regulation to follow your forecast; we did not read that regulation (regla 3.ª).
  2. Those monthly bases are provisional (regla 6.ª).
  3. From the following year, using the earnings the tax authority reports, the Seguridad Social spreads the year's earnings proportionally over the period being regularised and works out definitive monthly bases (308.1.c) and regla 3.ª).
  4. On our reading of the art. 308.1.c) regla 3.ª wording quoted below, if your definitive base is already between the minimum and maximum of the band your earnings fall into, no regularisation is made.
  5. In other words, the check compares your definitive base with the band your earnings fall into.
  6. If what you paid was below the cuota for that band's minimum base, you pay the difference by the last day of the month after you are notified, with no late-payment interest or surcharge if you pay within that time.
  7. If what you paid was above the cuota for that band's maximum base, the TGSS refunds the difference, without interest, before 30 April of the year after the one in which the tax authority reported your earnings to it.

Art. 308.1.c) regla 4.ª: the BOE margin note says the wording of the apartados 1.a) regla 5.ª and 1.c) regla 4.ª was given to art. 1.5 of the Real Decreto-ley 13/2022 by the disposición final 10.1.a) and b) of the Real Decreto-ley 14/2022.

The words behind each step follow. Art. 308.1 says what contributions follow:

(LGSS art. 308.1)

Choosing the base

Art. 308.1.a), regla 1.ª, on the choice:

(LGSS art. 308.1.a), regla 1.ª)

Regla 2.ª refers to a reduced table for a forecast below tramo 1 of the general table; the calculator page shows both tables:

(LGSS art. 308.1.a), regla 2.ª)

Regla 3.ª, on changing the base as the forecast changes:

(LGSS art. 308.1.a), regla 3.ª)

Regla 6.ª, on the status of the monthly bases:

(LGSS art. 308.1.a), regla 6.ª)

Changing the base in 2026

The Seguridad Social's own page on contributions for the self-employed shows no last-updated date. It states, for 2026, that contributions follow annual net earnings and that the base follows from their monthly average:

And on changing the base during 2026, in the page's own words:

That is the page's statement for 2026, which we have not checked against a BOE text, so we give it as the page's wording. How a change takes effect is not covered here.

Checking the base afterwards

Art. 308.1.c) is about the regularisation. It says when it happens and what it uses:

(LGSS art. 308.1.c))

Regla 3.ª, on how the earnings are spread and when, on our reading, no regularisation is made:

(LGSS art. 308.1.c), regla 3.ª)

Regla 4.ª, on what happens if the provisional contributions were below the cuota for the minimum base of the band your earnings fall into:

(LGSS art. 308.1.c), regla 4.ª, first paragraph)

And if they were above the cuota for the maximum base of the band:

(LGSS art. 308.1.c), regla 4.ª, second paragraph)

A Seguridad Social news item dated 13/12/2024 describes the regularisation of the 2023 exercise. It is dated and about that exercise only: we found no timetable for 2025 or 2026, and we give none.

(Seguridad Social news, 13/12/2024)

IVA on invoices to businesses: what the law text says, without a conclusion for your invoices

This section covers invoices to businesses only. IVA also has other place-of-supply rules and special rules for particular kinds of supply; we did not research them, so nothing here describes the position for any creator or any invoice.

Art. 69 of the Ley del IVA is headed Lugar de realización de las prestaciones de servicios. Reglas generales. That is the place where services are treated as supplied, under the general rules (reglas generales), so special rules exist. Its first paragraph opens with a lead-in that makes the list which follows subject to other provisions, including two articles it names. Keep it in view:

69.Uno (lead-in))

The first case on that list:

(LIVA art. 69.Uno.1.º)

In English: the first case is a service whose recipient is a business or professional acting as such, with its seat of economic activity, a permanent establishment or, failing those, its domicile or habitual residence in the territory where the tax applies, provided that the services are for that seat, establishment, domicile or residence, whatever the place where the supplier is established and wherever it supplies them from. The lead-in is a reason not to read this case alone, and we do not say what it means for any particular invoice.

The text above defines when a service is treated as supplied in Spanish IVA territory. It does not, in what we quote, say how an invoice to a client outside Spain is treated; we did not research that.

Who is the taxpayer

Art. 84.Uno.1.º is the general case:

(LIVA art. 84.Uno.1.º)

A later paragraph of the same article is about the purchases of a business or professional from a supplier that is not established in the territory where the tax applies. The exceptions follow in the article, and we do not paraphrase them. This paragraph is about what the purchaser is treated as; it does not describe what happens to your own invoices:

(LIVA art. 84.Uno.2.º a))

Obligations of taxpayers

Art. 164.Uno lists obligations of IVA taxpayers, subject to requirements, limits and conditions set by regulation. The quote has cuts, marked with an ellipsis:

(LIVA art. 164.Uno)

Whether and when any of these apply to an individual is not something this guide decides.

Returns and deadlines, as the Agencia Tributaria states them

The Agencia Tributaria (AEAT) publishes a page for each form. The titles, the descriptions and the windows below are its words, with the date each page shows. We do not say which of them apply to you, and you should read the AEAT page itself before relying on a window.

What each form is for, in the AEAT's own titles

These are the titles of the AEAT's pages, copied as they appear. They are not a list of the forms that apply to you.

FormTitle of the AEAT page
Modelo 303“Modelo 303. IVA. Autoliquidación.”
Modelo 130“Modelo 130. IRPF. Empresarios y profesionales en Estimación Directa. Pago fraccionado.”
Modelo 349“Modelo 349. Declaración Informativa. Declaración recapitulativa de operaciones intracomunitarias.”
Modelo 390“Modelo 390. IVA. Declaración Resumen Anual.”
Modelo 347“Modelo 347. Declaración Informativa. Declaración anual de operaciones con terceras personas.”
Modelo 036“Modelo 036. Censo de empresarios, profesionales y retenedores - Declaración censal de alta, modificación y baja.”

The ROI has no page title among our quotes; it is covered under its own heading below.

Modelo 303 (IVA)

The title of AEAT's page:

“Modelo 303. IVA. Autoliquidación.” (AEAT, Modelo 303 (G414))

Its instructions for 2026 say who uses the form and give the quarterly window:

(AEAT, Modelo 303, instrucciones 2026)

Instructions page date: Página actualizada: 09/junio/2026. Title page date: Página actualizada: 13/octubre/2026.

Modelo 130 (IRPF)

The title of AEAT's page, and what it says the form allows:

“Modelo 130. IRPF. Empresarios y profesionales en Estimación Directa. Pago fraccionado.” (AEAT, Modelo 130 (G601))
(AEAT, Modelo 130 (G601))

Page date: Página actualizada: 03/agosto/2026.

The instructions give the window. Their last sentence is a rule for a deadline that falls on a Saturday or a non-working day. We found that rule in the Modelo 130 instructions only, so we do not extend it to any other form:

(AEAT, Modelo 130, instrucciones)

Instructions page date: Página actualizada: 11/septiembre/2026.

The rule for actividades profesionales

The Modelo 130 instructions and the Reglamento del IRPF (art. 109) contain a rule for people who carry out professional activities (actividades profesionales). It turns on whether income was subject to withholding (retención) or to a payment on account (ingreso a cuenta):

This is the rule as written for actividades profesionales, and it depends on withholding having been applied to the income. We do not say whether a creator's activity is an actividad profesional, whether any income is subject to withholding, or at what rate: we did not research the rates.

The test counts only income for which tax was withheld or paid on account (the quote says hubieran sido objeto de retención o ingreso a cuenta); we did not research which invoices carry withholding. This only matters if your clients withheld tax. We have not researched whether yours do.

Modelo 390 (IVA annual summary)

The title of AEAT's page, and the general rule on its filing-window page:

“Modelo 390. IVA. Declaración Resumen Anual.” (AEAT, Modelo 390 (G412))

Title page date: Página actualizada: 13/octubre/2026. Window page date: Página actualizada: 09/junio/2026.

That is the general rule. The window page also prints a window for a particular year, which we do not reproduce: check it on the AEAT page. The last sentence of the art. 164.Uno quote above is the IVA law's own mention of an annual summary declaration. We do not say who has to file this form.

Modelo 347

The title of AEAT's page, and the periodicity its filing-window page gives:

“Modelo 347. Declaración Informativa. Declaración anual de operaciones con terceras personas.” (AEAT, Modelo 347 (GI27))

Title page date: Página actualizada: 21/julio/2026. Window page date: Página actualizada: 08/septiembre/2026.

AEAT describes the periodicity as annual and publishes the filing window on its page: check it there. We did not research who has to file this form, or any threshold or condition.

Modelo 349

The title of AEAT's page:

“Modelo 349. Declaración Informativa. Declaración recapitulativa de operaciones intracomunitarias.” (AEAT, Modelo 349 (GI28))

AEAT's instructions (a PDF) say who files, and define the services involved:

(AEAT, instructions for Modelo 349 (PDF))
“3º. (AEAT, instructions for Modelo 349 (PDF))

We give these as AEAT's definitions for this form. They concern services that AEAT describes as taxed in another Member State, and the quote about who files refers to art. 79 of the IVA regulation, which we did not read. The filing-window page gives a quarterly window, and the instructions give, among other conditions, a test for it:

(AEAT, instructions for Modelo 349 (PDF))

Title page date: Página actualizada: 13/octubre/2026. Window page date: Página actualizada: 08/septiembre/2026. The PDF shows no date; the Modelo 349 page (GI28) shows «Página actualizada: 13/octubre/2026».

The window page also gives a window for monthly filing, which we do not reproduce.

The ROI and Modelo 036

AEAT's page on identification for operations with other EU businesses says:

(AEAT, identification for operations with other EU businesses (ROI))

On how inclusion in the register is requested, and on the wait:

(AEAT, identification for operations with other EU businesses (ROI))

In English: if the Agencia Tributaria has not decided within three months, the assignment of the requested number may be considered refused. We do not say whether any creator's operations are among those on AEAT's list.

Payment in kind

Two rules we found are worth pointing to when payment is not in money. We apply neither. First, the personal income tax law, art. 28.4, on the value to use for goods or services that the taxpayer gives away or supplies at a price well below market value. It is not a rule about what a creator receives:

(Ley 35/2006 (LIRPF), art. 28.4)

Second, a signpost only: the IVA law, art. 79.Uno, on the tax base where the consideration is not money:

(LIVA art. 79.Uno)

How income tax treats gifts, products or barter that a creator receives is something we did not research, so we state nothing about it. The Agencia Tributaria may have guidance written for creators, which we also did not search for.

The IAE and the census

The AEAT page on the Impuesto sobre Actividades Económicas (IAE) says what the tax covers:

Its page on which model to file refers to Modelo 840 and to a registration that states the group or epígrafe:

The census declaration is a separate form. The title of AEAT's page on Modelos 036 and 037:

“Modelo 036. Censo de empresarios, profesionales y retenedores - Declaración censal de alta, modificación y baja.” (AEAT, Modelos 036 y 037)

Page date: Página actualizada: 24/septiembre/2026.

We do not say whether a creator has to register for the IAE, which group or epígrafe would apply, or whether the tax applies to a creator at all: we did not research those rules. To look up an activity, the AEAT's IAE page offers two search tools, labelled “Herramienta Buscador Actividades Económicas” and “Buscador de actividades y sus obligaciones tributarias” (AEAT, Impuesto sobre Actividades Económicas). We recommend no epígrafe.

Questions to take to a gestor

  • Ask whether the activity of a content creator meets the RETA definitions quoted above.
  • Ask whether an IAE epígrafe applies to your activity.
  • Ask whether invoices to clients outside Spain carry Spanish IVA.
  • Ask whether Modelo 349 applies to you.
  • Ask whether the Modelo 130 rule on withheld income applies to payments from your clients.
  • Ask whether gifts or products you receive are treated as income for income tax.
  • Ask whether your forecast of net earnings points to a particular monthly base.

  1. Numbers: the autónomo social security calculator for the cuota at an expected income, and the employee or autónomo calculator to compare an offer with invoicing.

  3. For the questions we could not answer, ask the Agencia Tributaria and the Seguridad Social, whose pages we link above.

What we couldn't confirm officially
  • Whether the activity of a content creator or influencer meets the definitions in Ley 20/2007 art. 1.1 or LGSS art. 305.1, and so whether it falls under the self-employed scheme (RETA): no official text we read answers it, so the guide quotes the definitions and draws no conclusion. unverified
  • Whether a creator's activity counts as an "actividad profesional" or an "actividad empresarial" for income tax, including for the 70% rule for Modelo 130 quoted on the page: we did not research it, and the rule is quoted only as the rule for "actividades profesionales", which depends on withholding having been applied. unverified
  • The rates of income-tax withholding (retención) on invoices: we did not fetch or research them, so the guide states none. unverified
  • How IVA treats services supplied to private individuals rather than businesses, including customers in other countries, the one-stop shop (OSS), the place-of-supply rules in arts. 70 to 73 of the Ley del IVA and any foreign VAT: not researched. The guide covers only invoices to businesses, quotes art. 69.Uno.1.º as the text states it and does not say it applies to any creator's income. unverified
  • The Impuesto sobre Actividades Económicas for a creator: which epígrafe (if any) would apply, and whether an individual is exempt. We did not read the tariffs or the exemption rules, so the guide links to the AEAT's activity-finder tools only. unverified
  • Who must file Modelo 347 and Modelo 390, their thresholds and exemptions, and the filing windows for the current year: we did not research them. The guide says only that Modelo 347 is annual, that AEAT publishes its window, and quotes the general January rule for Modelo 390. unverified
  • Whether the Saturday or non-working-day rule also applies to Modelos 303, 390, 347 and 349: we found it only in the Modelo 130 instructions, so it is attributed to that form alone. unverified
  • How income tax treats gifts, products or barter that a creator receives, and any AEAT guidance written for creators: not searched. LIRPF art. 28.4 is quoted only as the rule for goods or services the taxpayer gives away or supplies for a notably low price, and LIVA art. 79.Uno only as a signpost to the IVA tax base when payment is not money. unverified
  • The regularisation timetable for the 2025 and 2026 exercises: we found none. The only dated official item is the Seguridad Social news item of 13/12/2024 about the 2023 exercise, so the guide relies on the law's wording ("a partir del año siguiente") and gives no dates. unverified
  • Whether the Seguridad Social page that states six changes of contribution base in 2026 is still current: it shows no last-updated date, so the guide labels it as that page's own 2026 statement. unverified
  • Verifactu, which the Modelo 303 page of the Agencia Tributaria links to under 'Sistemas informáticos de facturación y VERI*FACTU', and its dates: named here only, not researched. unverified
  • The influencer registry rules (Real Decreto 444/2024): named in our research notes only, not read. unverified
  • The regulation that regla 3.ª of LGSS art. 308.1.a) refers to ('en los términos que se determinen reglamentariamente'): we did not read it, so the guide does not say how a change of monthly base takes effect. unverified
  • Who files Modelo 349: the AEAT instructions refer to the operations in art. 79 of the Reglamento del IVA, which we did not read. The test for quarterly filing ('sea superior a 50.000 euros, excluido el Impuesto sobre el Valor Añadido') is the AEAT instructions' own wording, which we have not checked against that regulation. unverified
  • The windows for Modelos 303, 130 and 349: they are what the AEAT pages state on the dates shown beside each quote, and they may change, so check the AEAT page before relying on one. unverified
  • Whether any platform, brand or agency income counts as an economic activity for RETA, IVA or income tax: no official text we read answers it, and the guide names no platform. unverified
