Beckham law: how to apply with Modelo 149, as the BOE and the AEAT word it

What the BOE texts (Ley 35/2006, the Reglamento del IRPF, Orden HFP/1338/2023) and the pages of the Agencia Tributaria say about opting in to the Beckham regime with Modelo 149: the time limit as worded, who files, the documents, the order of the steps and the electronic channel, with what we could not confirm.

This page reports what the BOE and the Agencia Tributaria's pages say; it is not advice.

Spain has a special tax regime, known as the Beckham law, for people who move to Spain for certain kinds of work. It is set out in article 93 of the Ley 35/2006 del Impuesto sobre la Renta de las Personas Físicas (IRPF, the personal income tax law). The option to be taxed under it is communicated to the Agencia Tributaria (AEAT, the Spanish tax agency) with a form, Modelo 149. This page reports what the BOE, the official gazette, and the AEAT's own pages say about that communication: the legal basis, the time limit as worded, who files, the documents, the order of the steps and the electronic channel. It does not say who may opt in, it computes no date, and it gives no rate, amount, fee or processing time. Quotes are in Spanish, with the article or page, a link, the date that source shows and the day we read it, 18 October 2026. The English after a quote is our translation or our summary, and says which; it is not a translation to rely on.

If you read only one thing

  • The six-month limit is not on the AEAT's Modelo 149 page as we read it. It is worded in the Reglamento (art. 116.1), the Orden (art. 7.4) and the AEAT Manual, and its starting point has alternatives: see the six months, as worded.
  • Each family member has a separate communication, the main taxpayer's comes first, and the Reglamento words a separate limit for family members: see family members.
  • The texts give a sequence of two electronic steps: the supporting documents are sent first, in a separate step, and the registration number of that sending goes on the Modelo 149: see documents first, then the form.
  • The accrediting document is worded with «si procede». We did not confirm how long it takes in practice: see the accrediting document.

What we could not confirm

  • The conditions for filing electronically, and the route «Aportar documentación complementaria»: the Orden refers to articles 18, 19, 20 and 21 of Orden HAP/2194/2013, which we did not fetch. unverified
  • The Modelo 149 form itself and the accrediting document (annexes II and III of the Orden): the BOE page shows only their headings, we did not read them, and this page describes no box or screen. unverified
  • The AEAT's electronic forms «Aportar documentación necesaria para optar por el régimen especial» and «Modelo 149. Presentación»: they are dynamic and need identification, we did not open them, and the step order on this page is taken from the page text and the Orden only. unverified
  • Who may file for a taxpayer beyond the help page's wording (a registered «colaborador» or an authorised «apoderado»): we found nothing on other filers, and this page says nothing on them. unverified
  • What follows from a communication filed outside the time limit: we found no text on it among the pages we read, and this page says nothing on it. unverified
  • How long it takes in practice for the tax administration to issue the accrediting document: the Reglamento and the Orden word a maximum of «diez días hábiles» with «si procede», none of the AEAT pages quoted here words a time for it, we did not confirm it, and this page gives no processing time. unverified
  • What «el inicio de la actividad que conste en el alta» means for a given person (the date of the registration, the first day of work, the date of the contract): the texts word it only as quoted, and this page gives no example and no interpretation. unverified
  • The effect of the accrediting document on withholding, and when the Modelo 151 return is due: outside this page, which quotes only what the Reglamento says about the document. unverified
  • The documents the Reglamento lists for the other routes (letters d) to g) of article 119.2), and the Manual pages for those routes and its summary table: not quoted here. unverified
  • What Real Decreto 1008/2023, cited in the BOE notes under articles 116 and 119, changed: we did not fetch it, and this page does not describe it. unverified
  • What Ley 28/2022 changed in article 93, beyond what the article itself words: not described here. unverified

The texts, and the dates their pages show

The procedure sits in three BOE texts and in the AEAT's pages. The Ley gives the option. The Reglamento del IRPF (Real Decreto 439/2007) words the time limit and the communication. The Orden HFP/1338/2023 approves Modelo 149 and words the filing. The titles and date lines, as the BOE pages print them:

(Ley 35/2006, title)

BOE consolidated text, header «Última actualización, publicada el 07/10/2026»; read 18 October 2026

In short (our summary, not a translation): the title of the personal income tax law, which also amends three other tax laws. In English (our translation) of the date line: consolidated text, «last update, published on 07/10/2026».

(RD 439/2007, title)

In short (our summary, not a translation): the title of the Real Decreto that approves the Reglamento del IRPF and amends the regulation on pension plans and funds. The date line says the same as the Ley's: consolidated text, last update published on 07/10/2026. The BOE page lists a version line for the articles quoted below. For article 116:

“Última actualización, publicada el 06/12/2023, en vigor a partir del 07/12/2023.” (Reglamento del IRPF, art. 116, version line)
BOE consolidated text, header «Última actualización, publicada el 07/10/2026»; arts. 115 to 119 version published 06/12/2023, in force 07/12/2023; read 18 October 2026

In English (our translation): last update, published on 06/12/2023, in force from 07/12/2023. The BOE prints the same line after articles 115, 117, 118 and 119. It also prints these two notes, which this page quotes and does not describe:

“Se modifica por el art. 1.10 del Real Decreto 1008/2023, de 5 de diciembre. Ref. BOE-A-2023-24841” (Reglamento del IRPF, art. 116, BOE note)

In English (our translation): it is amended by article 1.10 (under article 116) and by article 1.13 (under article 119) of Real Decreto 1008/2023, of 5 December. This page does not describe what that Real Decreto changed.

(Orden HFP/1338/2023, art. 6)

In English (our translation): model 149 «Personal income tax. Special regime applicable to workers, professionals, entrepreneurs and investors displaced to Spanish territory. Communication of the option, renunciation, exclusion, or end of the displacement» is approved, which appears as annex II of this order.

How long the regime lasts, as worded

Article 93.1, quoted above, words the period as the tax period of the change of residence and the five following tax periods. The Reglamento words it in article 115:

BOE consolidated text, header «Última actualización, publicada el 07/10/2026»; arts. 115 to 119 version published 06/12/2023, in force 07/12/2023; read 18 October 2026

In English (our translation): this special regime will apply during the tax period in which the taxpayer acquires tax residence in Spain, and during the five following tax periods, or, for the taxpayers referred to in paragraph 3 of article 93 of the Law, until the last tax period in which it applies to the taxpayer referred to in paragraph 1 of article 93 of the Law, without prejudice to what is established in articles 117 and 118 of this regulation. For these purposes, the tax period in which residence is acquired will be considered to be the first calendar year in which, once the displacement has taken place, the stay in Spanish territory is more than 183 days. Our Beckham law calculator counts 6 tax years in total.

Who files, and the tax register

Article 116.1 of the Reglamento says who communicates the option and how:

BOE consolidated text, header «Última actualización, publicada el 07/10/2026»; arts. 115 to 119 version published 06/12/2023, in force 07/12/2023; read 18 October 2026

In English (our translation): 1. The exercise of the option to be taxed under this special regime must be made by an individual communication from each taxpayer addressed to the tax administration: The Orden words the model, the tax register, the two kinds of taxpayer and the order of the communications:

(Orden HFP/1338/2023, art. 7.1)
«BOE» núm. 299, 15/12/2023, in force 16/12/2023; read 18 October 2026

In short (our summary, not a translation): the Orden says the taxpayers who wish to exercise the option must use communication model 149 and must be included in the Censo de Obligados Tributarios (the register of tax obligors), otherwise they first request registration in the Censo by filing the census declaration; it defines the «contribuyente principal» (the taxpayer of art. 93.1) and the «contribuyentes asociados» (those of art. 93.3); and it says the communication is made individually by each taxpayer, that of the main taxpayer before those of the associated taxpayers. The preamble of the Orden says:

(Orden HFP/1338/2023, preamble)
«BOE» núm. 299, 15/12/2023, in force 16/12/2023; read 18 October 2026

In English (our translation): the option has to be individual for each taxpayer, both for the main taxpayer and for each of the associated taxpayers who wish to opt, although the associated taxpayers have to identify in their communication the prior communication filed by the main taxpayer, as article 119.3 of the Reglamento establishes. The AEAT's Modelo 149 page words the register and the order of the communications too:

(AEAT, Modelo 149 page)
AEAT page, «Página actualizada: 16/marzo/2026»; read 18 October 2026
(AEAT, Modelo 149 page)
AEAT page, «Página actualizada: 16/marzo/2026»; read 18 October 2026

In English (our translation): taxpayers who wish to exercise the option to be taxed under this special regime must have a NIF (tax identification number) and be included in the Censo de Obligados Tributarios; otherwise, they will first request registration in that Censo by filing the census declaration. The communication of the option will be made individually by each taxpayer, and the communication by the main taxpayer will be made before that of the associated taxpayers.

The six months, as worded

The AEAT's Modelo 149 page, quoted further down, does not word a time limit as we read it on 18 October 2026. The limit is worded in the Reglamento, in the Orden and in the AEAT Manual. The Reglamento, article 116.1.a), for the main taxpayer:

BOE consolidated text, header «Última actualización, publicada el 07/10/2026»; arts. 115 to 119 version published 06/12/2023, in force 07/12/2023; read 18 October 2026

The determination of the link of these taxpayers with the taxpayer referred to in paragraph 1, and of their age and disability, will be made according to the situation existing at the time of exercising their option for the special regime. The Orden words the same limit in article 7.4:

(Orden HFP/1338/2023, art. 7.4.a) and b))

In short (our summary, not a translation): the Manual says the communication is filed individually by each family member who wishes to opt, within the longer of two windows: six months from entry into Spanish territory, or six months from the start date of the activity shown in the registration with Social Security in Spain or in the documentation that allows the home-country legislation to be kept or, where registration was not compulsory, in the supporting document, if longer; and it repeats that the link, age and disability are fixed at the time of exercising the option. What «el inicio de la actividad que conste en el alta» means for a given person is not stated by the texts we read, and this page gives no example and no interpretation. Our Beckham law calculator page records the limit as 6 months.

In short (our summary, not a translation): article 7.2 of the Orden lists, for the main taxpayer, the same kinds of document as article 119.2 of the Reglamento, in its own wording; this page does not compare the two texts word by word. The AEAT Manual's page on the documents restates the general list and, as its first case, the employer's supporting document:

(AEAT Manual Renta 2025, documents)

In short (our summary, not a translation): the Manual page says the communication of the option must be accompanied by the supporting documentation of the registration with Social Security in Spain, or the documentation that allows the home-country legislation to be kept, or the document proving the start date of the activity, the residence authorisation where applicable, and, in the first case, the employer's supporting document for a new employment relationship.

Documents first, then the form

In short (our summary, not a translation): the Orden and the AEAT's Modelo 149 page word a sequence of two electronic steps. First, the supporting documents are sent in a specific step, «Aportar documentación necesaria para optar por el régimen especial». Then the Modelo 149 is filed, and the registration number of that sending must appear in it. This page states no other order. The AEAT's Modelo 149 page:

In English (our translation): to exercise this option they will file model 149. They will also use this model to renounce this regime or when they are excluded from it for failing to meet any of the conditions determining its application. Questions to take to the tax office or a gestor

  • Ask whether the start date of the activity for the situation is the one on the Spanish social security registration, on the papers that keep home-country social security, or on a document proving it.
  • Ask whether the documents for the situation are complete before they are sent in the first step.
  • Ask whether the limit for each family member is the entry date or the main taxpayer's period, whichever is longer.
  • Ask whether a gestor can file the communication on the taxpayer's behalf.
  • Ask whether the documents for the routes in letters d) to g) of article 119.2 apply to the situation.
